Effective August 25, 2026 · Updated September 7, 2026
Services and agreement
The selected package, approved additions, session date, location, inclusions, fees, and any required retainer are shown in the accepted proposal, invoice, or written booking agreement. The session schedule and location will be confirmed approximately seven days before the session.
Payment and reservation
A retainer is required only when stated in the proposal, invoice, or booking agreement. If required, its amount is the amount agreed there and it is nonrefundable to the extent permitted by law. The date is reserved only after Studio confirmation and receipt of any required retainer. The remaining balance and approved travel charges are due at least seven days before the session unless the written invoice states otherwise. Services and final photographs may be withheld until cleared payment is received.
Photographic work and delivery
Photographs are captured digitally. Final edited photographs are delivered as high-resolution JPEG files through a private online gallery no later than six weeks after the session, unless a different written timeline applies or circumstances outside the Studio’s reasonable control cause delay. RAW files and unselected proofs are not delivered. The gallery remains available for fourteen days after delivery. The client must download and back up the files during that period and report any issue or requested change within fourteen days.
Artistic discretion
The Studio retains professional discretion over posing, lighting, composition, image selection, editing style, effects, and the final appearance of delivered photographs. No particular pose, moment, expression, person, object, background, or image beyond the package inclusions is guaranteed.
Client responsibilities
The client will arrive on time, supervise participating minors, follow reasonable safety directions, and obtain permissions and permits required by a location. Time lost because of late arrival does not extend the scheduled session. Approved additional time is billed at $100 per hour, per photographer, plus applicable sales tax.
Safety and events outside control
The Studio may pause or end coverage if conduct is threatening, hostile, offensive, or unsafe. If the photographer cannot perform because of illness, emergency, fire, casualty, unsafe conditions, an act of God, or another event outside reasonable control, the Studio may provide a comparable substitute photographer. If no substitute is available and rescheduling is not agreed, amounts paid for undelivered services will be refunded.
Copyright, model release, and personal license
MarLens Studio LLC retains copyright in the photographs. The client authorizes the Studio to reproduce and display images from the session for the Studio’s marketing materials, portfolio, samples, editorial submissions, website, social media, and studio display. When images include a child, the signing parent or legal guardian grants the same permission. Use to promote another business requires the client’s prior written permission. After full payment, the client receives a nonexclusive personal-use license for the final delivered images, including personal printing and permitted social-media sharing. The client may not sell, sublicense, materially alter, use for third-party advertising, enter in a contest, or commercially exploit the images without written permission.
Liability and applicable law
To the extent permitted by law, liability for failure to deliver because photographic materials are lost or damaged without the Studio’s fault is limited to amounts paid for the affected services. Nothing in these terms waives a right or liability that cannot legally be waived. Texas law applies, and signed proposals, invoices, releases, and written amendments form part of the agreement.
